The website letzlingo.lu ("Site") is a web page operated by M. M. Studios S.à r.l.-S ("MMS", "we", "us", and "our").

Intellectual Property

The Service contains intellectual property owned by MMS, including, without limitation, trademarks, copyrights, proprietary information, text, graphics, designs, and other intellectual property, as well as the name, logo, and brand elements of MMS and the Service. This includes, but is not limited to, the registered trademark LETZLINGO®. All rights are reserved.

You may not use, modify, publish, copy, distribute, reproduce, or create derivative works from any of the Service content or intellectual property, in whole or in part, without our prior written consent. Unauthorized use of the LETZLINGO® trademark is strictly prohibited and may result in legal action.

Processing of Personal Data

Your personal data will be processed in accordance with our Privacy Policy, available at https://www.letzlingo.lu/pages/privacypolicy.

Payment and Access Terms

Users can access the Service under either the Free Tier or by subscribing to "LetzLingo Premium." The LetzLingo Premium subscription grants access to additional features and services on a recurring basis—either monthly or yearly, as selected at the time of purchase. The subscription will automatically renew at the end of each billing period unless deactivated through the "Manage Billing" section in your account settings. If you cancel your subscription, you will continue to have access until the end of the current billing period, and no refunds will be issued for any unused portion. Free Tier

The Free Tier allows anonymous users to access limited features of the Service without requiring registration or payment. MMS reserves the right to modify or discontinue the Free Tier at any time without notice. Users acknowledge that their access to the Free Tier is provided on an "as-is" and "as-available" basis.

"LetzLingo Premium" Subscription

To access "LetzLingo Premium" users must register for an account and pay the applicable fees as displayed at the time of purchase. Access to "LetzLingo Premium" will only be activated upon successful payment.

To access "LetzLingo Premium," users must register for an account and subscribe by selecting either the monthly or yearly plan and paying the applicable subscription fee as displayed at the time of purchase. Access to the premium features and services will be activated upon successful processing of the initial subscription payment, and will continue on a recurring basis unless canceled through the "Manage Billing" section in your account.

Account Registration

To access "LetzLingo Premium" you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities under your account. MMS is not liable for any loss or damage arising from unauthorized access to your account.

Anonymous users of the Free Tier are not required to register but are subject to these Terms of Service when accessing the Service.

Taxes

All fees for the "LetzLingo Premium" subscription are exclusive of any applicable taxes, duties, or charges imposed by taxing authorities. You are responsible for the payment of all such taxes, duties, or charges.

Termination of Access to "LetzLingo Premium" for Non-Payment

Access to "LetzLingo Premium" is provided through a subscription model based on monthly or yearly billing periods. If your subscription fee is not successfully processed due to payment issues, access to "LetzLingo Premium" may be suspended until the payment issue is resolved. If the issue persists, your subscription may ultimately be terminated. Additionally, if you cancel your subscription, you will continue to have access until the end of the current billing period, after which your subscription will not be renewed. Meanwhile, you will still have access to the Free Tier features as an anonymous user.

Refund Policy

All subscription payments for "LetzLingo Premium" are final, and no refunds will be issued for any unused portion of the subscription period, except as required by applicable law or in the event of a material breach of these Terms by MMS.

If you believe you are entitled to a refund due to a technical issue or a failure of the Service to perform as described, you must submit a written request to moien@letzlingo.lu within 14 days of the issue. Refund requests will be reviewed and approved at the sole discretion of MMS, in accordance with applicable law.

Changes to Pricing and Free Tier

MMS reserves the right to change the pricing of the "LetzLingo Premium" subscription at any time. Any changes to the subscription fees will not affect your current billing period but will apply to all subsequent renewals. Additionally, MMS reserves the right to modify or discontinue the Free Tier, at its discretion and without prior notice.

Modifications to the Service

MMS reserves the right to change, modify, add or remove information, products, services of the Free or "LetzLingo Premium" subscription, and other Site content at any time and without notice. Such modifications do not constitute grounds for a refund of any fees.

Third Party Services

The Services may refer to websites or contain links leading to websites that are not managed by MMS. You acknowledge and agree that we are not responsible or liable for the information or services of these third party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with MMS. You acknowledge and accept that we are not responsible for the terms or practices of third parties. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

Limitation of Liability

We do not guarantee the quality, accuracy, completeness, relevance of the information/content on this Site nor that the Services will function without interruption or error, or that faults will be corrected. In no event, shall we be liable for any direct, indirect, incidental or consequential damage that may be caused by using the Services.

Governing Law and Jurisdiction

These Terms and Conditions and all non-contractual obligations due or correlated to them are governed and construed according to the laws of the Grand Duchy of Luxembourg. Any disputes due or correlated to these Terms and Conditions will be submitted to the Courts of the District of Luxembourg.

If any clause contained in these Terms and Conditions becomes void, unenforceable or prohibited in any jurisdiction, this will not affect the validity and enforceability of the other clauses in these Terms and Conditions, or of these same clauses in other jurisdictions. In such cases, MMS and you agree to replace the clause that is void, unenforceable or prohibited with a valid, enforceable clause in the spirit of the original.
